My Practice

I graduated from the Mar­shall-Wythe School of Law, College of Wil­liam and Mary in 1968. I be­gan my care­er de­fend­ing pro­tests and try­ing con­tract claims as an at­tor­ney-ad­vis­er with the De­fen­se Lo­gis­tics Agen­cy’s De­fen­se Con­struc­tion Sup­ply Cen­ter. I was ap­point­ed as an Ad­min­i­stra­tive Judge, Gen­eral Serv­ices Ad­min­i­stra­tion Board of Con­tract Ap­peals, in 1980, and even­tual­ly became the GSBCA’s Vice Chair­man. I heard and de­cid­ed many ma­jor con­tract claims aris­ing from fed­er­al con­struc­tion proj­ects and from fed­eral leas­es of of­fice and ware­house space. In 1985, I be­came in­creas­ing­ly in­volv­ed in the GSBCA’s new pro­test juris­dic­tion over com­pu­ter and tele­com­mu­ni­ca­tions ac­qui­si­tions. I left the GSBCA in 1987 to en­ter pri­vate practice.

My practice focuses on pro­tests aris­ing from awards of fed­er­al and state contracts, see, e.g., Lear Seig­ler Serv­ices, Inc., B-280­834, Nov. 25, 1998, and Boeing Sikor­sky Air­craft Sup­port, B-277­263.2, Sept. 29, 1997, and on claims aris­ing from per­form­ance of these contracts. I rep­re­sent con­trac­tors and fed­er­al, state, and local agen­cies. In ad­di­tion to pro­tests and claims, I rou­tine­ly pro­vide ad­vice to pri­vate clients on white-col­lar fraud de­fense issues, de­bar­ments, civil fraud claims, cost is­sues, small busi­ness stat­us is­sues, and team­ing/sub­con­tract dis­putes. I as­sist pri­vate clients in pre­sent­ing their po­si­tions be­fore Congress.

I have received the As­sist­ant Sec­re­tary’s Award for Ex­cellence from the United States De­part­ment of State, Bureau of Ad­min­i­stra­tion, and in 1991, I re­ceived Fed­er­al Com­pu­ter Week’s Fed­er­al 100 Award. I am an au­thor and fre­quent lect­ur­er on gov­ern­ment con­tracts, pub­lic con­tract law, and lit­i­ga­tion topics.

Member of the Virginia and Dis­trict of Col­um­bia bars. Ad­mit­ted to the Sup­reme Court of Vir­gin­ia, United States Dis­trict Court for the Dis­trict of Col­um­bia, United States Dis­trict Court for the East­ern Dis­trict of Vir­gin­ia, United States Court of Fed­er­al Claims, United States Court of Ap­peals for the Four­th Cir­cuit, United States Court of Ap­peals for the Fed­er­al Cir­cuit, United States Court of Ap­peals for the Dis­trict of Col­um­bia Cir­cuit, and Su­preme Court of the United States of Amer­ica.
